Of course we had known this all this while. And now, consumer forum recognizes it too!

The Life Insurance Corporation of India has become the “richest” organisation in the country by rejecting rightful claims of insured under mediclaim policies on “flimsy” grounds, the Delhi State Consumer Commission has said.

We say, why just LIC? The statement holds true for every insurer in the country. They may not be the ‘richest’ but rich they are and how!

The State Commission too recognized this issue as a major source of concern. In one of the most clear cut stands in the recent times, the Delhi State Commission said, ”We have deprecated this practice of insurance companies of taking a flimsy clue or remote reference from the discharge summary or statement with a view to reject the rightful claim of the insured. It appears that this is how the respondent (LIC) has become one of the richest organisation in India.”

Reiterating another of Tadka’s vehement arguments, the Commission also said that LIC should realise that it “survives and thrives” on consumer and “propensity to become unjustly rich by rejecting their claims” is highly depreciable.

What triggered the Commission’s ire was denial of the claim of a policy holder’s husband, who had died due to infection after surgery for removal of her uterus. The insurance firm had rejected his claim on the sole ground that she had concealed that she had undergone angiography eight years prior to availing the policy despite subjecting her to rigorous medical tests before issuing the policy to her.

Clearly holding that it is the duty of the insurer to ensure that the policy holder is fit before issuing the policy, the Commission also observed that this obligation is not duly discharged by the insurers because they will lose business.

The Commission held that LIC is liable to pay Rs 20 lakh as the amount of the policy to the complainant and it shall also pay Rs four lakh as compensation for mental agony, harassment and sheet suffering to him.

New India Assurance and consumer issues are as inseparable as recently lovestruck hormonal teenage couple. Talk of insurance troubles and New India Assurance would be right there, making its presence count.

This may either be the law of averages at play, considering New India Assurance is one of the most prominent insurers in the country with a policy holder (and ensuing trouble) count to match or the company is plain sadist–your guess is as good as ours.

Nevertheless, in this latest incident, New India Assurance has been ordered by a the Central District Consumer Disputes Redressal Forum in New Delhi to pay Rs 1.05 lakh to a policy holder for rejecting his claim for medical expenses incurred on treatment of his injuries suffered in an accident.

The Forum held that denial of the mediclaim by the insurance firm by relying on the medical report, which mentioned smell of alcohol from claimant’s breath, was “not justified” as no examination was conducted to see if he was under the influence of alcohol at the time of accident. The order was passed ex-parte.

In a separate incident in far South, a coconut on a car’s windshield snowballed into a major trouble for ICICI Lombard, when it deliberately ignored the claim of Rs. 6,823 for the damage suffered by the vehicle that was insured with it.

The Hyderabad-based Insurance Ombudsman allowed the reimbursement of actual expenses incurred for repair, but disallowed the cost, interest, and compensation claimed by Mr. Karnawat, the consumer. The Dakshina Kannada District Consumer Disputes Redressal Forum however upheld his claim and ordered ICICI Lombard General Insurance Company to pay Rs. 10,000 as compensation for harassment suffered by the consumer and Rs 2000 as litigation costs  for ignoring a claim of Rs. 6,823.

Striking a perfect geographical balance, the heartland of the country, Madhya Pradesh too reported an erring insurer taken to task by the consumer forum. In this incident, the National Insurance Company refused to pay the full amount claimed by the policy-holder for his BMW insured with the company and damaged in an accident.

The insurer contended that the damage was not entirely the result of the accident but has actually happened subsequently when the car was being taken for repair to Mumbai. The story was obviously rejected by the forum and

Chhattisgarh State Consumer Court has ordered the National Insurance Company to pay `34,57,700 to Manoj Kumar, the aggrieved consumer against the loss to the insured vehicle in a road accident. NIC has also been asked to pay interest at 9 per cent, payable from 20 May 2010, p.a. on the aforesaid amount which includes compensation for mental, physical as well as financial loss incurred due to the non settlement of the complainant’s claim.

Insurance regulator IRDA today imposed a penalty of Rs 6 lakh on SBI Life Insurance Company for violation of various norms.

The Insurance Regulatory and Development Authority (IRDA) has also reprimanded SBI Life saying “… business practices adopted by life insurer (SBI Life) and the intermediaries involved, severely dent the faith of insuring public”.

SBI has been held guilty of not only paying higher commission to the intermediaries but also not giving insurers informed choices.

We still don’t understand the reason behind the frequency of insurance related complaints. The more we hear about them, the more we are convinced that this industry just doesn’t care for its consumers.

The latest is against Kotak Mahindra Insurance.

In this case, the complainant, a senior citizen wanted a policy issued in his wife’s name. But, the policy was not issued in his wife’s name but issued in his name and it was also not a life insurance policy as was agreed upon at the time of payment of premium. The consumer was later issued a new policy, which he returned within 15 days and then had demanded refund of premium of Rs. 11,808 but the insurance company had not returned the amount.

The New Delhi District Consumer Disputes Redressal Forum deemed this as an Unfair Trade Practice and has ordered Kotak Mahindra Old Mutual Life Insurance to pay Rs. 36,800 for cheating the customer and not returning him the premium amount paid for a policy—which he had returned within the 15-day free-look period.
